strkBTC Faucet Terms of Use

These Terms of Use (the "Terms") govern participation in the strkBTC faucet distribution campaign (the "Campaign"). The Campaign is operated by the Starknet Foundation, incorporated in the Cayman Islands with Limited Liability under registration number 393786 with its registered address c/o Leeward Management Limited, Suite 3119-9 Forum Lane, Camana Bay, George Town, PO Box 144, Grand Cayman KY1-9006, Cayman Islands ("the Foundation", "we", "us" or "our").
The terms "you", "your" or "user" refer to any individual participating in the Campaign. The Foundation and you may be referred to individually as a "Party" and collectively as the "Parties".
By accessing the Campaign website, connecting a wallet, or claiming a random amount of unshielded strkBTC (“Unshielded strkBTC”), shielded strkBTC (“Shielded strkBTC”), and a determined amount, at the Foundation’s discretion, of STRK Tokens (“STRK”), collectively referred to as the “Tokens”, you agree to be bound by these Terms. If you do not agree, do not participate.
The Foundation reserves the right to amend these Terms at any time.
1. Eligibility
To be eligible to participate in the Campaign, you must:
- Not be a resident of, or subject to the laws of, any jurisdiction covered by applicable sanctions restrictions.
- Have a valid and active account on X (formerly Twitter) that passes an automated eligibility check to filter out certain ineligible accounts. The Foundation may decline registration or distribution where an X account fails this check, which assesses factors such as account standing, account age, activity level and followers. Accounts verified by X may be subject to different criteria. The Foundation reserves the right to disclose the thresholds applied and reserves the right to adjust these at any time without notice.
- Hold or control a compatible wallet address capable of receiving the Tokens on the Starknet network.
- Comply with these Terms in their entirety.
Participation in the Campaign is strictly limited to one claim per user, per X account, and per connected wallet.
2. Nature of the Campaign
The Campaign operates as a faucet distribution mechanism. The Campaign contains a fixed and capped pool of Unshielded strkBTC. After registration closes, a subset of registered users may be selected to receive Unshielded strkBTC according to the Campaign's distribution rules. Distribution of Unshielded strkBTC per user is determined randomly at point of distribution and the total amount received, if any, cannot be guaranteed in advance. Distribution is subject to users meeting the eligibility criteria and compliance with these Terms.
Users deciding to opt in to shielding their distributed Unshielded strkBTC, may be eligible to receive an additional, equal amount of Shielded strkBTC. For this purpose, registered users selected to receive Unshielded strkBTC and Shielded strkBTC may also receive STRK for the exclusive purpose of covering applicable fees in connection with shielding strkBTC.
The Campaign is not an initial coin offering or any other form of public token sale or distribution. Specifically, you acknowledge and agree that: (i) the Campaign does not constitute an offer or solicitation to purchase, sell, or invest in any token or digital asset, (ii) Tokens distributed through the Campaign have no guaranteed economic value, and (iii) the Foundation makes no representations as to the future value, liquidity, or utility of any Tokens distributed through the Campaign.
3. No Consideration to Participate
Participation in the Campaign requires no consideration from you. We will not require you to make any financial commitments, payments, fees or other monetary considerations to participate.
4. Compliance and Wallet Screening
In order to comply with applicable laws and regulations, the Foundation will conduct wallet address screening and related checks of user wallets selected to receive Unshielded strkBTC according to the Campaign’s distribution rules (the "Screening Procedures"). By participating in the Campaign, you expressly consent to the Screening Procedures, which may include automated screening of your connected wallet address against applicable international sanctions lists and watchlists, or such other checks as the Foundation or its compliance service providers deem necessary.
The Foundation reserves the right, in its sole discretion, to decline to distribute the Tokens to any wallet address that does not pass the Screening Procedures without any obligation to provide reasons for such refusal.
5. No Obligation to Distribute
You acknowledge and agree that participation in the Campaign creates no legal obligation on the part of the Foundation to distribute Unshielded strkBTC, Shielded strkBTC, or STRK to you. The Foundation expressly reserves the right, in its sole discretion, to:
- Modify, suspend or terminate the Campaign at any time and for any reason, without the requirement to provide prior notice.
- Decline any distribution to you if you do not pass the Screening Procedures, if you engage in Prohibited Conduct (as described below) or as the Foundation otherwise deems appropriate.
- Reduce, adjust, or suspend the quantity of Tokens available through the Campaign.
- Impose additional eligibility requirements or claim limits as it deems appropriate.
6. Disclaimers and Limitation of Liability
The Campaign and all distributions thereunder are provided on a “as is” and “as available” basis without warranty of any kind, expressive or implied. To the fullest extent permitted by applicable law, the Foundation makes no representations or warranties of any kind, whether express, implied, statutory, or otherwise, in relation to the Campaign, the Tokens or any associated services; and (ii) disclaims all warranties, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, and quiet enjoyment; any warranty arising from course of dealing or usage of trade; any warranty that the Campaign, websites or services, internet, or blockchain networks will operate without interruption or error; and any warranty as to the accuracy, completeness, availability, or security of any content, data or information.
To the fullest extent permitted by law, you shall defend, indemnify, and hold harmless the Foundation and its Affiliates, licensors, and each of their respective officers, directors, employees, and representatives against all losses arising from or relating to: (i) your participation in the Campaign; (ii) any breach on your hand of these Terms; and (iii) a violation of applicable law.
To the fullest extent permitted by law, the Foundation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your participation in the Campaign or your use of any strkBTC.
7. Prohibited Conduct
By participating in the Campaign, you expressively agree and acknowledge that you will not:
- Attempt to make more than one claim per X account or wallet address, attempt to circumvent the one-claim-per-user limit or eligibility requirements.
- Use automated scripts, bots, or engage in sybil behaviour to circumvent claim limits or eligibility requirements.
- Engage in any conduct that the Foundation reasonably considers to be abusive, manipulative or otherwise contrary to the purpose and intent of the Campaign.
The Foundation reserves the right, at its sole and exclusive discretion, to disqualify any user found to have engaged in Prohibited Conduct from the Campaign.
8. General
8.1. Intellectual Property
All intellectual property rights in and to the Campaign website, branding, and related materials are owned by or licensed to the Foundation. Participants are granted no licence or rights in respect of any such intellectual property by reason of their participation in the Campaign.
8.2. Waiver
No failure by the Foundation to enforce any provision of these Terms shall be construed as a waiver or limitation of the Foundation’s right to subsequently enforce and compel strict compliance with such provision or any other provision of the Terms. The Foundation shall not be deemed to have waived any claim arising out of the Terms, or any provision, power, right, privilege or remedy under the Terms, unless the waiver is expressly set forth in writing by the Foundation; and any such waiver shall not be applicable or have any effect except in the specific instance in which it is given.
8.3. Severability
These Terms are severable. If any term is held to be invalid or unenforceable for any reason, the remaining terms will continue to be valid and enforceable. If a court finds that any term is invalid or unenforceable, but that by limiting such term it would become valid and enforceable, then such term will be deemed to be written, construed, and enforced as so limited.
8.4. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Cayman Islands, without giving effect to any conflict of law principles and the Parties agree that the courts of the Cayman Islands shall have exclusive jurisdiction over any dispute or issue arising out of these Terms.
